Terms of Service & Disclaimers

These Terms of Service (“Terms”) govern your use of services provided by 88 NewWin Sites, a division of 88 NewWin LLC (“we,” “our,” “us”). By signing up for a plan, you agree to these Terms. The website-facing summary on this page is for transparency; the binding contract is the signed Website Hosting & Service Agreement you receive at sign-up.

1. Services

We design, build, and host WordPress websites for small businesses. Each plan includes hosting, a domain, a contact form, basic on-page SEO, and ongoing technical maintenance for as long as the subscription is active.

2. Plans & Pricing

  • Pro Plan — $49/month: 3-page WordPress site, mobile-friendly, hosting + domain included
  • SEO Growth Plan — $79/month: Everything in Pro Plan, plus monthly blog content, Yoast SEO setup, Google Search Console, and sitemap submission
  • Buyout — $1,500 one-time: Full site files and domain transferred to you. You take over hosting from that point. Available anytime.

3. Billing

Plans are billed monthly via Stripe on the day you sign up. Payment is in U.S. Dollars. We do not charge setup fees. If a payment fails, we will attempt to retry; if unresolved within 14 days, we may suspend service until payment is brought current.

4. Cancellation

Cancel anytime. Cancellations take effect at the end of your current billing month. We do not pro-rate refunds for partial months. To cancel, email dannyn@88newwin.online.

5. Site Ownership & Buyout

During your subscription, we own and operate the website (design files, code, hosting). You provide the content and license it to us to display. At any time, you may exercise the Buyout: pay $1,500, and we transfer the full site files plus the domain to you. After Buyout, you own the site outright and take over hosting and maintenance.

6. No Guarantees

We do not guarantee specific results. Website performance, search engine rankings, lead volume, and revenue depend on factors beyond our control — including your local market, competition, ad spend, sales process, and Google’s algorithm. We commit to delivering a professionally built, technically sound website. We do not commit to specific traffic, ranking positions, conversion rates, or business outcomes.

7. Intellectual Property

We retain ownership of the website design, code, and templates during your subscription. You retain ownership of the content (text, photos, logos) you provide to us. Upon Buyout, ownership of the assembled site transfers to you.

8. Acceptable Use

You agree not to use our services for anything illegal, fraudulent, defamatory, or harmful. We reserve the right to suspend or terminate service for violations of this section.

9. Limitation of Liability

To the maximum extent permitted by law, our liability under these Terms is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or business interruption.

10. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your content, your use of the services, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Orange County, California.

12. Changes

We may update these Terms. Material changes will be communicated by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
